This episode delves into the unsavery practice of judges having prevailing parties, more than not prosecutors, write their decisions, opinions and orders, in effect having prosecutors being the real people writing judicial precedent.  This practice, though frowned upon by the United States Supreme Court and admonished by appellate courts and state bar associations across the country, remains a legitimate and lawful practice - based upon the pretense that though these judicial opinions passed to others to write still contain at least a true assessment of court proceedings.  However, as is typically the case, Montana takes a questionable practice and makes it a status quo for simply letting judges avoid doing their actual jobs and letting prosecutors actually be the ones to control precedent and the overreaching, prejudicial orders enforced in the state.
